Board Policies

1      Parking
Residents are required by the covenants and restrictions to park “off-street.  Vehicles should be parked in the garage or driveway. No vehicles should be parked in the yard or on the sidewalks at any time. If a resident is having guests, the homeowner should make certain that their guests do not park in the street in such a manner that prevents access for emergency vehicles or causes any inconvenience to their neighbors. Where practical, suggest visitors to park on one side of the street.

2      Up lighting Guidelines
The Board of Directors has determined that landscape lighting may include “up lighting”. Guidelines are as  follows:

The lighting units should be white light only, “low voltage” and no more than 25 watts.

The fixtures should be no more than 8 inches above the ground and be dark green, dark brown, or black in color. It is the intent of this policy to make fixtures virtually invisible from the street.

The spots should point at trees, shrubs, or the home. There should be no spillover glare onto adjoining properties.

The fixtures should be a minimum of six feet apart and not more than four fixtures should be in front of the house.

All outside lighting plans must be submitted to the ARC for approval.

3      Pergola
A pergola is typically a garden structure that consists of pillars that support an open roof structure, such as a trellis. Pergolas are sometimes used as a transition from indoor living space to the outdoors, and commonly cover walkways or paths. Pergolas, which are somewhat similar to an arbor, are often covered in plants

Pergolas should be no taller than the eaves of the house and no larger than 12 feet by 15 feet.

 They should attached to or abutting the back of the house.

No hanging lights, ribbons or streamers

Only natural vines, climbing plants or hanging plants

Color may be a neutral stain or painted to match the trim of the house.

Must be approved by the ARC

4      Campers, RV’s , Trailers and Boats
The Board of Directors recognizes that as homeowners we have all agreed to abide by the terms of the Covenants and Restrictions.  The question of allowing campers, trailers, boats or RV’s to be parked in a driveway, especially during football season has been raised. The guideline to be followed asks that you stay within the Covenants and Restrictions as much as possible. If it is necessary for you to park your own RV, Camper etc. in your driveway, do not leave it there for more than 24 hours.  If you need to keep it for more than 24 hours, please remove it from Caldwell Crossings.  Please be mindful that parking your  RV, camper or trailer on the street is not permissible at any time.

5      Window Screen Policy
Applies to all windows that can be seen from the street:

·        Window screen frames must be baked on enamel to match the color of the window frame.

·        Window screen crossbar must be the same height as the middle of the window frames where the two halves come together.

·        Window screen material must be black or dark brown/bronze

·        Window screens that are torn or damaged must be replaced immediately

·        Prior to placement of window screens, ARC approval must be obtained

·        The ARC may ask for a sample of the frame and screen material.

 

6      Vinyl Windows
All homes are required to install wood windows unless otherwise approved by ARC. The ARC will consider vinyl clad windows if they have the following characteristics:

·        Wood window appearance

·        Double hung

·        Brick mold

·        If vinyl, virgin vinyl only

·        Sloping sill with at least a 10 degree slope

·        Check rail ( strip between upper and lower windows) should be a minimum of 1 ¼ inches

·        If transom is used above the window, it should be an integral part of the window.

·        If the replacement windows being considered contain these characteristics, the ARC would meet with the vendor and /or homeowner to review the product prior to installation.

 

7      TRASH/RECYCLE CONTAINERS Please help in keeping our neighborhood neat looking. Some homeowners are putting trash receptacles and/or trash bags at the curb several days prior to pickup service. When this happens on weekends, it is particularly unsightly to neighbors and guests visiting our area. Trash collection days are Wednesday and Saturday for recyclables and trash. In accordance with Section 6.20(b) of the Caldwell Crossings Covenants, “trash cans and containers shall always be kept at the rear or inside a dwelling and shall be screened from view from streets and adjacent lots and dwellings by appropriate landscaping or fencing approved by the ARC, unless placed at the curb on the day of pickup by the waste pickup service for the Development.” Since trash pickup comes early, it is permissible to place trash receptacles or recycle containers at the curb the evening of the day prior to the pickup service, no earlier than 5:00 PM. On the day of the trash/recycle pickup, containers should be returned to their storage place no more than 12 hours after such pickup. Homeowners who use a lawn service company to maintain their yards should have the lawn service company take the grass and/or tree clippings with them or have them stored in accordance with the Covenant requirements

8    Yard/Garage Sale Guidelines 

In accordance with the Caldwell Crossings Covenants and Restrictions residents may hold a yard/garage sale that follows the following guidelines:

  • Yard/Garage sales may be held on Friday and Saturday beginning no earlier than 7:00 AM and ending no later than 3:00 PM.
  • Yard/Garage Sales may be held on Sunday beginning no earlier than 12 noon and ending no later than 3:00 PM.
  • While Section 6.22 of the Covenants disallows most signage in the neighborhood, a limited number (4 or 5) signs will be allowed on the day of the sale but must be removed immediately at the conclusion of the sale.
  • Approval must be granted by any homeowner on whose property a directional sign is placed.
  • In all cases, residents must have prior approval from the Architectural Review Committee for their planned yard/garage sale.

9  Political Signs

No political signs will be allowed to be placed on homeowner’s property.  This includes removable campaign signs, i.e. magnetic decals, attached to vehicles, which would be visible from the street.

Further, under no conditions are political campaign signs to be placed on the Common Areas at the entrances to Caldwell Crossings. This stipulation also applies to any of the Common Areas maintained by the Association.

The policy established by the BOD for dealing with violations of Section 6.22. Signage will be on the Caldwell Crossings Owners Association website

 

10   Policy for Nominations for Board of Directors

*  Must be a homeowner in Caldwell Crossings
*  Reside in Caldwell Crossings
Be in good standing with the Association
This requires the Candidate: 

Have no liens on the property
Have no unpaid fines or late charges on their account
Have no open C & R violations on the property

 

11 American Flag Display

The American flag may be flown at any time from a bracket attached to the dwelling in

accordance with the established protocol for displaying the American flag. In part here is

the proper way to display at night:

The Flag Code states it is the universal custom to display the flag only from sunrise to sunset on buildings and on stationary flag staffs in the open. However, when a patriotic effect is desired, the flag may be displayed 24 hours a day if properly illuminated during the hours of darkness

 

12  BANNER POLICY

Due to the interest in college football, the display of a university or college flag is allowed only during football season, generally August through January.  The flag or banner may be flown from a bracket attached to the dwelling or a stand placed in the ground but not a flag pole..

Flags/banners can be displayed 24 hours before game time kick-offs.

Flags/banners are to be removed 24 hours after game time kick-offs.

A university or college flag or banner is not to be displayed on days the team has an open date.

No prior approval from the ARC is required for the display of university flags or banners.

Any other use of flags, banners, windmills, etc. must have prior approval from the ARC.

13  Door and Yard Décor

Front and Side Yard

Only holiday decorations are allowed in front or side yards.  Holiday decorations should be taken down within 15 days after the holiday.

Wreaths on Doors

Wreaths are permitted at any time and only on front doors.

(A wreath is defined as a round or square band of flowers, foliage or any ornamental work or garland used for a decorative purpose.)

Never allowed:

(VI6.1 from covenants and restrictions.)  

Bird feeders, wood carvings, plaques, home crafts are not permitted on front or side of residence.

(VI6. 7c from covenants and restrictions

No rocks, rock walls, or other substances shall be placed on any lot as a front or side yard border or to prevent vehicles from parking on or preventing pedestrians from walking on any portion of such lot or to otherwise impede or limit access to property.  No bird baths, fountains, reflectors, flag poles, statues, lawn sculptures, lawn furnishings, artificial plants, rock gardens, rock walls, bird houses or fixtures and accessories shall be placed or installed on or within any lot or dwelling which would be visible from any public or private street providing access to property.

VI 6.1f (from covenants and restrictions)

Bird feeders, wood carvings, plaques, home crafts are not permitted on front or side of residence.

Utility Line Covers

To conceal exposed utility lines, pipes, etc., an ARC form must be submitted describing the materials to be used for the cover
